These Terms of Service ("ToS") govern your access to and use of the RougeFraise website and its private beta waitlist.

Publisher

The RougeFraise website (hereinafter "the Platform"), accessible at rougefraise.ch, is published and operated under the RougeFraise brand name.

Definitions

• Platform: the RougeFraise website and all its services.
• User: any person accessing the Platform.
• Advertiser: an adult individual who, upon the launch of the service, submits a classified advertisement on an independent basis.
• Ad: advertising content published by an Advertiser.
• Venue: a professional operating a physical location or structure (parlor, club, agency, institute, sauna/spa) who publishes one or more ads.
• Member: a registered User who views the ads.

Purpose

These ToS define the conditions of access to and use of the Platform. By accessing the site or registering for the private beta waitlist, the User unreservedly accepts these ToS.

Beta Phase

The Platform is currently under development; a beta phase is scheduled for this purpose. The only service available at this stage is waitlist registration to be notified of its opening. The described features regarding Advertisers and ads will become available upon the launch of the service and are subject to change.

Conditions of Access

Access to the Platform is strictly restricted to persons who are at least 18 years of age and possess full legal capacity. By using the Platform, the User certifies that they meet these conditions. Access is prohibited where restricted by applicable law.

Nature of the Service

The Platform is an online advertising network: it connects Advertisers (independent escorts, women, men, or trans individuals, erotic massage providers) and Venues (parlors, clubs, agencies, institutes) with adult Users across French, German, and Italian-speaking regions in Switzerland. It solely provides space for publication and connection. It does not offer any services of a sexual nature, does not arrange encounters, and does not collect any commission on them; its liability ends at making the introduction.

Waitlist Registration

Registration requires a valid email address and the explicit consent of the User. Data is processed in compliance with the Privacy Policy. Users may unsubscribe at any time.

User Obligations

The User agrees to:

• provide accurate information;
• not use the Platform for unlawful purposes;
• not compromise the functionality or security of the Platform;
• respect the rights of third parties.

Content and Moderation (Upon Launch)

Upon the launch of the service, all published content must be lawful, accurate, and respect human dignity. The Platform reserves the right to refuse, suspend, or remove any content that violates these ToS or applicable law without prior notice, including but not limited to any content involving minors or human trafficking.

Intellectual Property

The RougeFraise brand name, its visual identity, and all website elements are protected. Any reproduction without authorization is prohibited.

Liability

The Platform is provided "as is." To the fullest extent permitted by law, the publisher shall not be held liable for content published by Users or for any relationships formed between them. The publisher uses reasonable means to ensure the availability and security of the service, without guaranteeing that it will be uninterrupted.

Data Protection

The processing of personal data is described in the Privacy Policy.

Modifications to the ToS

The publisher may modify these ToS at any time. The applicable version is the one in effect on the date the Platform is used.

Governing Law and Jurisdiction

These ToS are governed by Swiss law. Subject to mandatory legal provisions, the exclusive venue for any disputes shall be the registered place of business of the publisher.
